It depends if it is a kinship placement or not. If the child is related to you, you can file for adoption as part of the termination of parental rights or anytime thereafter. If it is a kinship placement, the case worker should explore the possibility of you adopting the child as part of their permanancy plan for the little one. If this is NOT a kinship placement and you are a foster parent, you need to have the child in your care continuously for one year before you have standing to sue for custody/adoption of the child. Hope that helped some.

What percentage of children that are removed from parents are given to grandparents for permanent custody?

Not enough unfortunately. Usually, if the child is removed from both parents' care before legal guardianship is established, the child is remanded to the custody of the state. At that point, it becomes more difficult (and expensive) for grandparents to gain custody. There are heartbreaking stories all over the place of grandparents trying in vain to get custody of their grandchildren.

Is a minor giving up baby for adoption permanent my 16 yrd old niece is pregnant with second child and may give him up for adoption Will she be able to fight for himher once shes an adult?

No. She made the choice to give him or her up before the child was born; unless the family then has issues and she has an opportunity to claim custody, no court would simply allow you to claim back a child you didn't want after someone else took care of them for years and raised them in their home. She can try to find him when his of legal age. Not before that. She could try to find a couple that would be willing to do a semi or open adoption. We are trying to adopt, and that's what were going to do if the birth mom is okay with it. She could maintain contact with the family, and her child. That said, if she does place the baby for adoption, it is the adoptive couple that would be that child's mom and dad. I don't know of any court that would reverse an adoption just because the birth mom wanted her baby back when she is ready. I would definitely reach out to couples that would work with her on an open adoption.

How do you give up temporary legal and physical custody?

you don't. giving up or terminating your parental rights is forever. What are you trying to do. If you are trying to suspend child support for a time or need to give temporary custody of the child over to the other parent for a short time due to illness, school, business, and the like, file a "modification of final judgment of (paternity, divorce, etc) and request the change before the Judge. If the other party is in agreement, it can be done simply and at little cost to you with a stipulated agreement.
