If she had taken her son (your step-son) and left your young child alone and un-supervised in the house, she would have been liable for 'Child Endangerment' (for knowingly leaving a child home alone). Kidnapping is a criminal offense and must be done with a CRIMINAL INTENT. If her INTENT was not criminal, then there was no crime.
