I believe it has to do with the way it is worded on the application. Some ask if you've ever been convicted of a crime, or ever been convicted of a crime involving a child etc, and some will ask only if you've been convicted of a felony. Regarding expungement, any job that requires an FBI check, meaning where you will have to do fingerprinting, it is my understanding that it will show. So you're better off saying you had an expunged record and be able to show documented proof, then someone find out later, which would be an automatic termination and could prevent you from getting work in the future since most applications ask if you've ever been fired. You also don't want to worry everyday that someone will find out. If they do an FBI check and nothing comes up, great. But if it does or they don't catch it right away, it could spell problems for you. Maybe even new charges for falsifying documents depending on what type of job it is.

Good luck to you.

How can someone have a DUI charge expunged from their record?

Having a DUI charge expunged from a record is a tedious task. Being eligible means answering a few questions first. Was it the first and only conviction? How much time has passed since the conviction? What was the severity and nature of the crime? After these are answered you can fill out an application for expungement from the local court house.

Can you get a mister meaner expunged?

For each state to get a misdemeanor expunged depends on what the crime was for, how long it has been since your sentence, and if you have paid all your fines and fees. Also remember that just because your record is expunged does not mean it is still not on your record. It just shows that the judge has found you guilty of the charge but you have served all your time and you are making right.

Can you be prosecuted after years of service if you answered no to the crime question but the answer was yes if the information was found in a background check and your employer let you keep your job?

If you lied on the application, it is a long stretch to imagine that your employer would let you keep your job. Depending on the crime and the time that has passed since your conviction, it may have been expunged from your record.

Is resisting arrest a crime Do i have to put yes on a job application when they ask Have you ever been convicted of a crime?

Yes, resisting arrest is a crime. If the conviction occurred a long time ago and you have not had any trouble with the law since then, many states have a process that allows the old conviction to be 'expunged' or sealed. The conviction will show up during any thorough background check, even if it is expunged. Bummer. You are better off the admit it and explain it than have the record appear during a formal background check.
