The Defense of Marriage Act ("DOMA") is a federal statute. However, many states have adopted state laws (sometimes called "mini-DOMAs") that effectively ban same-sex marriage. Sometimes these state statutes merely define marriage as being between a man and a woman. Some states go further and explicitly state that any marriages not meeting this description are null and void. Voters in some states, fearing that a state court would rule the statute in violation of the state constitution, have amended their state constitutions to contain similar language and therefore protect the prohibition from judicial review.
