The legality of both running the site and using the site is hardly as clear cut as previously suggested, and an honest answer would be 'noone really knows'. Torrenting is downloading from thousands of different sources to get the single file that you want, so by it's very nature it is hard to A) prove anything and B) be caught.
I think it probably is illegal. However, the prices people are charged for music/films/games nowadays should be illegal too. If musicians, publishers, developers etc just put more effort into turning out quality products worth the asking price they'd suffer less from illegal downloading. The fact is, you can't charge over the odds for shoddy merchandise and not expect and element of illegal acquisition of your wares.
