This is a strange question but the answer lies in why the one person lives. If someone convinces someone else to enter a suicide pact with no intention of committing suicide but the other person does, you could be held legally accountable for their death. If you find that you are unable to go through with it when the moment arises, it would be better to reveal this change-of-heart to the person before they commit suicide in case your decision has an impact on theirs but you are not necessarily responsible for their death by simply changing your mind at the last moment. If you tried and failed, depending on your level of success in failing (nearly died - failed a little/completely fine - failed a lot), you may have worse problems to deal with than whether what you've done was illegal. It most likely will boil down to whether you entered the pact sincerely and the circumstances surrounding your failing to commit suicide.
With that said, you and whomever you are entering a pact with should talk to someone before making a decision you cannot take back.
