It is a still criminal offense in Maryland, believe it or not. But the maximum sentence as of this writing in 2017 is a paltry $10 fine.

However, it does have an effect on divorce proceedings for the cheating spouse. Not only does it affect alimony and child custody, but if the adultery can be conclusively proven in court based on a somewhat strict set of standards, the divorce can be granted immediately rather than requiring 1-2 years of separation that are normally required to finalize a divorce.
