Bigamy means that the first marriage is the legal one, not the second one. If you are the second spouse, you are not legally married. The first marriage still stands and your spouse needs to get it handled legally. The spouse that illegally remarried is also in some deep legal trouble. Bigamy is against the law! In my opinion, if you are the second spouse, get out of there NOW! And protect the assets your brought into this relationship before it's too late. Don't think you got a prize in this person who deceived you and the first spouse.

If your spouse files for a divorce and you refuse to divorce them will a judge grant the divorce anyway?

Yes - if you live within a jurisdiction with "no-fault" divorce laws. Where "at-fault divorce" laws are in effect, a party requesting a divorce must demonstrate that there are grounds for the divorce. If, for example, someone files for divorce on the grounds of adultery in a jurisdiction where "at-fault divorce" is the law, and the other spouse disputes the grounds - i.e. denies adultery took place and refuses to agree to the divorce, a judge may deny the divorce petition. In some jurisdictions men may divorce their wives at-will, but women may not divorce their husbands without their husband's consent.

Do you have to file an annulment if your spouse committed bigamy?

A person can only be married to one other person at a time. If a person attempts to marry a second spouse while they are legally still married to the first, the second marriage is void as a matter of law. An annullment action pre-supposes that the second marriage was legal, which is incorrect, therefore there is no need to annul it.
