Don't know for sure about your state, but, as far as I know they are all uniform on these. You have to have a signed work order before starting any repairs. Sometimes a verbal over the phone will work, but I wouldn't put a tech on task with a verbal only. The shop also has to notify you if the repairs are to exceed the written estimate by more than 20%. The only variance that I am aware of is if the repair is a warranty issue to be done by the dealer, and is of no charge, labor, or parts, to the customer. There is also a clause in some states concerning the smog, or safety of said vehicle, and/or other peoples safety on the road. If you go in to have your tires rotated, and your brakes are completely shot, they can detain your vehicle from further use until such repairs are made. Even then they need a signature to continue. You would also have the option of towing the vehicle out of that shop to another, or, to your home.

Should Automobile be fixed or replaced?

To the intelligent person, that decision should be a function of the value of the REPAIRED vehicle as compared to the projected cost of repair. You should determine the value of the vehicle BEFORE repair, add that amount to the cost of repair and if that total is MORE than the value of the vehicle after repair, sell the vehicle without repair. Some people have an emotional attachment to a vehicle. That changes the way you make decisions.

How do you get your insurance company to repair a new vehicle with new original parts instead of used and aftermarket parts?

It is illegal for a body shop to repair a car with used or reconditioned parts, unless the owner of the vehicle gives written permission. Insurance companies do not control repair shops. Their repair estimates are based on new factory parts and standard repair charges. I have recently found out that it depends on what state you live in. For example, in Pennsylvania, insurance companies are permitted to use aftermarket or used parts to repair a vehicle but if those parts affect the vehicles warranty the insurance company must warrant those parts. Unfair, but very true!!
