Is it illegal for a 38 year old man date a 17 year old girl?

First, a 17-year-old is not a man. Second, a minor's parents have the right to determine who their child is and isn't allowed to spend time with, and I really can't imagine a parent giving permission for their 17-year-old to date a 38-year-old. But when he turns 18, he's free to do whatever he wants.

Added: As stated above, the 17 year old is NOT a man, he is a juvenile-minor, and you could be prosecuted for statutory rape.
