2. you did not say who was doing the killing, meaning police killing a criminal or anything.

So, if you ask: Today in the State of Texas, if you commit murder of a police officer during the commission of another felony, can you be legally prosecuted and convicted of a capital offense resulting with the death penalty? That that answer would be yes.

OR, if you ask: Can my mom legally kill me if I cuss at her one more time? Then the answer would be no.

To be illegal there has to be a written statute in Law that has to be broken first.

It's a civil offence, it is abhorrent to normal people and jail or death can be the result of a trial in law, depending on which country or state you are in.
