Strict scrutiny
Women do not qualify as a "discrete and insular minority".
All suspected infringements of any Constitutional Amendment are subjected to review of the United States Supreme Court for their interpretation.
A court would most likely use strict scrutiny to examine laws that classify individuals based on race, national origin, or religion, as these classifications are considered suspect and warrant the highest level of judicial review. Strict scrutiny requires the government to prove that the law serves a compelling state interest and is narrowly tailored to achieve that interest. Additionally, laws that infringe on fundamental rights, such as voting or free speech, may also be subjected to strict scrutiny.
Strict scrutiny is very critical observation or examination.
All of the above are true
Well, it prevents crimes such as defamation and harassment. However, on the grand scale, censorship typically does more harm than good. Censorship, for that reason, is typically subjected to strict scrutiny in the United States.
All of the above are true
Almost every law that comes under strict scrutiny has been reversed, and almost every law that has come under rational scrutiny has been upheld. The different levels of scrutiny define the different standards the state law must pass. For a law to pass strict scrutiny, it must be narrowly tailored and least restrictive and the state must have a compelling state interest for its enactment. For a law to pass rational scrutiny, it must be rational (the law can be over-inclusive and under-inclusive) and the state has to show that it was accomplished legally. The state only has to show that the reason for its enactment is legitimate. The burden of proof also shifts from the defendant in rational scrutiny to the state in strict scrutiny.
