Generally, a court can always determine what the best course to resolve a problem is...and if it is something with someone opaying, normally that is a way to asssure payment, not jail. If your divorce decree stated that he was responsible for the back taxes, and he is not taking care of them, you should speak with an Attorney about what your options are. Be aware though, that the IRS does not care what your divorce decree says. They are going to come after both of you until arrangments are made.
