The U.S. Congress is a bicameral legislature consisting of an upper house, the Senate, and a lower house, the House of Representatives. Each of these two houses of Congress are laid out in Article I of the United States Constitution and the basic fundamentals surrounding the organization of Congress is reflected in the attitudes of the original 13 Colonies.

The smaller Colonies were fearful that the larger Colonies would use their population advantage to dominate over law making and so they favored the New Jersey Plan proposed by William Patterson which featured a unicameral legislature with equal representation for all states, similar to the way Congress was organized under the Articles of Confederation. The larger states wanted to retain the advantages of having a large population as it pertained to law making and so favored the Virginia Plan proposed by James Madison which featured a bicameral legislature with the lower house consisting of representation based on population and the upper house being elected by members of the lower house. The resulting Connecticut Compromise of 1787 found a middle ground.

The Connecticut Compromise created the foundations of the Congress that we have today. It consisted of the House of Representatives, with its seats being apportioned based on population, and the Senate, with each State being equally represented with two senators elected by each State's legislature. Members of the House of Representatives each serve two year terms while senators have six year terms

All spending bills that require an appropriation must be brought to the floor of the House of Representatives first, as this house is the closest to directly representing the people. This was to avoid the formation of an oligarchic senate controlling public funds. In instances of an electoral tie, the House of Representatives votes on who will become the next President of the United States. Members of the House have the power to elect their own officials such as Speaker of the House and majority and minority leaders.

The Senate questions and confirms Executive appointees such as Judges, Supreme Court Justices and members of the presidents cabinet. In instances of impeachment, the House of Representatives has the sole power to impeach a government official, after which the Senate then hears the testimony of the impeached official and votes either to convict or acquit. The Senate also has the power to "advice and consent" with the President to the enactment of treatise with other nations. As such, for the United States government to sign on to a treaty, it must pass a vote in the Senate. Senate deliberation is overseen by the Vice President who has the power to cast a tie breaking vote in the instance of legislative gridlock. In the Vice President's absence, a President pro tempore may be selected by the Senate to preside as is usually the case as the Vice President rarely presides over senate meetings. Originally, Senators were elected by their state legislatures but with the passage of the 17th Amendment in 1913, Senators are elected by a popular vote by the citizens of their state.

Currently, the House of Representatives consists of 435 seats apportioned based on the population of their respective states while the Senate consists of 100 seats with each state being granted two seats.
