Judges usually hire law students during their second or third years of law school to begin working as law clerks after they graduate. The term "law clerk" is also sometimes used to refer to law students who are working for a law firm for the summer or part-time during the semester, or after graduation while they are waiting for their bar results. Law clerks, whether they are working for a judge, a law firm, or some other legal employer, are people who are either in law school or who have recently graduated.

There are 3 phases to becoming a lawyer: you get a legal education, you pass the bar exam, and you get hired by a law firm. In theory you could also start your own law firm, although that is harder to do.

Law is largely a self-regulated profession. In the US, the bar association of each state controls who can practice law there. Most require an undergraduate degree from an accredited college or university, a law degree (JD or LLB) from a law school accreditted by the American Bar Association (a national organization of lawyers not connceted with any one state), passing a written exam, and passing a character and fitness review. But there are exceptions. I believe California will let an applicant take the exam if their law school was not ABA-accreditted and will admit you to the bar (that is, license you to practice law) if you pass. I don't think New York requires you to go to a law school at all--if you pass the bar exam and fitness review, you're in, though it's probably a bit more involved than that in real life.
