I would like toknow what is considered Sexual assault between an 8 year old female during visits with their father and a 12 year old ( soon to be )step brother - does him holding her down on his lap and moving her around constitute as sexual assualt - what are my rights in protecting my daughter against being sent into that situation again and making sure further incidents do not occur or put her into a harmful situation where something more could potentially happen ? The father has rights for every other weekend visitation - and despite my attempts at discussing this with him he sees nothing wrong with the behavior and I am concerned for the safety and well being of our daughter. I also have a 10 year old son who visits with his sister as well -s o far there has not been any mention from him that anything has happened to him. Thank you.
