I think the term you're looking for is "demur." To demur is to acknowledge that a statement of facts is true, but is still insufficient to proceed against the disfavored party. For example, Joe makes a complaint to the police about a party that his neighbor Bob is hosting. Joe says the party ius too loud and is disturbing his peace. The police issue a citation to Bob, and he has to appear in court. When Bob gets to court, he admits he was throwing a party, but that the noise from the party wasn't enough to disturb his neighbors. In so doing, Bob demurs or issues a demurrer to the complaint of Joe. The judge must now decide whether there is sufficient evidence to proceed with the charge against Bob.
The term is actually "sheepishly." It refers to someone who is embarrassed or demure because they lack self assurance.
Demure means someone who is modest and reserved in manner or behavior. Modest, or shy.
