if the child now resides with the parent then she should get the money because it belongs to the child. you are falsley receiving benefits if you allow this to continue. contact child benefit office and tell them new details. if residencey order was made then you both must be in agreement for the child to reside with you.if you agree then you do not have to go back to court to revoke it. if there is a dissagreement then the matter is put before a judge and they decide where the child lives if it is under the age of 10 approx.
also any benefit received by grand parent should be backdated to you from day of arrangement by the benefit office and paid to yourself.
IT IS ILLEGAL TO DO THIS!!!!!CONTACT THE BENEFIT OFFICE IMMEDIATLEY!!!
GOOD LUCK. HOPE THIS HELPS.XXX
child is slow grandparent is slower and parent is the fastest.
The parents are responsible for child support, not the grandparents. If the grandmother has legal custody the child support payments should go directly to her via a court order. All states in the US have child support guidelines, based on income and other factors, that must be used to calculate what the non-custodial parent(s) must pay.It should be noted that if the child lives with her grandparent that grandparent is already contributing to the child's support above and beyond the payments made by the parent(s). Child support payments rarely amount to enough to completely support the child.
If the custodial parent or grandparent's income is significantly higher than yours, you may be granted support based on your parenting time percentage with the child, but that would be an unusual situation.
Nah. I didn't have to, and my lawer said I didn't have to!(I am serious.)=This may depend on the state and county you live in. In parts of PA, if the grandparents are given custody of a child or have custody of a child, they CAN petition for child support, and yes the parents would have to pay for the care of that child.=
I don't see how the parent not paying child support play any role in custody for the grandparents. If the parents are found unfit the grandparents have a chance for custody just like other relatives do. The biological parents are still the ones paying child support. Not being able to pay child support does not make you a unfit parent.
Yes
The non-custodial parent can file for custody.
yes, as long as the parents agree to allow their child to live with their grandparents its fine as long as the grandparents can support the child.
This seems extremely unlikely.
Yes, but the other parent can challenge it.
The court decides if he is allowed to terminate his parental rights. The custodial parent can then give custody to a grandparent if they wish. Both of you would then have3 to pay child support to the grandparent. Terminating parental rights does not get you out of paying for the child.
Yes but if the grandparents need help from the government the order will be back on.
