Discharge by agreement means that where the discharge occurs with the free consent of both parties and without subsequent change of heart, there is no need for any particular form of agreement. the parties may simply abandon performance. In pratice, however, in order to guard against a change of heart by the other party, it will be desirable to adopt some form of legally binding agreement to discharge the contract.
