The legal definiton of reckless driving, per Illinois, follows. Please be advised that HB0508 has been sent to the Governor and is pending signature. If enacted, the law would be expanded to include reckless driving involving school children and/or crossing guards.

(625 ILCS 5/11‑503) (from Ch. 95 1/2, par. 11‑503)

Sec. 11‑503. Reckless driving; aggravated reckless driving.

(a) A person commits reckless driving if he or she:

(1) drives any vehicle with a willful or wanton disregard for the safety of persons or property; or

(2) knowingly drives a vehicle and uses an incline in a roadway, such as a railroad crossing, bridge approach, or hill, to cause the vehicle to become airborne.

(b) Every person convicted of reckless driving shall be guilty of a Class A misdemeanor, except as provided under subsection (c) of this Section.

(c) Every person convicted of committing a violation of subsection (a) shall be guilty of aggravated reckless driving if the violation results in great bodily harm or permanent disability or disfigurement to another. Aggravated reckless driving is a Class 4 felony.

Does an officer have to write a reckless driving ticket in addition to a speeding ticket for more then 40 over the posted speed limit in il?

In Illinois, if an officer observes a driver exceeding the speed limit by more than 40 mph, they are required to issue a reckless driving ticket in addition to the speeding ticket. This is because driving at such excessive speeds is considered a form of reckless driving under Illinois law. The officer has discretion in certain circumstances, but typically, both charges would be applicable.
