The term 'Mental DISORDER" is much too broad to define here, as it encompasses ANY and ALL manifestations of "abnormal" mental activity and/or illness that is other than what is considered "normal." I have never heard the diagnosis "Insane Automatism" but assume that it must be a more "impressive sounding" phrase meaning the same thing as 'Temporary Insanity.' Therefore, temporary insanity COULD be included under the heading of mental disorders. Doctors, Psychiatrists, Judges and Attorneys have argued, labored and sweated over the meaning of these conditions and to their application to criminal law and responsibility for one's own actions, and will probably continue to do so into the future. In the end juries usually decide the outcome of the arguments raised on both sides.

The word "automatism" refers to "non-insane" automatism, and is not found in the Code, but in the Common Law of Canada. See details re s. 16 at http://www.bastionlaw.ca/-insanity.asp

Before psychiatry or psychological treatment existed, there were insane asylums, which were essentially prisons. No one knew how to treat mental disorders, so the sufferers were locked up, probably for the dual purpose of protecting the patient from harming himself and keeping him out of the sight of society in general.
