republic act 9211 states that it is prohibited to smoke tobacco or cigarrettes in all enclosed (with roof) public places such us public transport, waiting shed, elevators, buildings,offices. Open spaces with no roofing such as roads, wide open spaces, parks, fields and the likes are not included in the prohibition, any local law made by cities or municipalities to prohibit smoking on open spaces as described above is a violation of RA9211, it has always been that any local law cannot supersede a National law.
