To some extent the rights of voting soldiers serving abroad came into play. Also though the 14th ammendment really should have put this to rest, Equal Protection Act, the Poll tax created an equality issue by posing this un-due tax burden. The same type of thing is being attempted today with national health-care. The government cannot create a "right" and impose a penalty for it. Health care is freely given anyway for emergencies and treatments you just need to understand its done out a human kindness initiative and sometimes there are long lines. If the government would get out or the way and let all health care providers compete freely across state lines the prices should drop with increased competition. The problem with that however is that people promoting their own agenda will and have increased government mandates to insure the expenses increase. The two party system is the problem, we no longer have representitives that are for the people but rather for the party they belong to.
