The 49cc engine is fine, but the top speed disqualifies the Ruckus as a class B moped (Limited use Motorcycle). Are you sure you don't mean a 60cc scooter? Because a motorcycle with a 600 cc engine is not called a scooter. For a scooter and moped with a 60cc engine or smaller, you need to be 16, attend a driving safety corse and pass a test.
