The states are given plenary or police power in the federal system. This means that all powers not granted to other branches of government are reserved for the states.

The powers that are not directly given to the federal government in the constitution fall in the hands of the state government. However, there is the elastic cause which allows the federal government to make laws as they deem necessary for the best interests of the government.
To the principle of separation of powers the Constitution contains the system of checks and balances. Each branch of the government exercises some control over the other branches. The purpose is to prevent any one branch or person from becoming too powerful in the federal government. The system, while preventing the concentration of power, also creates a system of shared powers between the branches.
