Unless he kills somebody in prison he will not be on death row again. He and his 'family' members were given the death penalty in the sentencing phase of the trial in 1969-1970. In 1972 the Supreme Court abolished the death penalty due to it's cruel and unusual punishment on prisoners. Their sentences were automatically reduced to life which at the time there was no 'life without parole' which left only life with possiblity of parole.

It doesn't seem fair but that's are judicial system. Not perfect, but what is?
