The US Supreme Court has ruled (Roper v. Simmons, 2005) that the death penalty may not be applied for crimes committed when the perpetrator was under 18. It's also true that the Supreme Court has ruled (Atkins v. Virginia, 2002) that mentally retarded people may not be executed. However, as far as I can tell, they've never put any restrictions on the maximum age.
