In the United States, the US Supreme Court ensures that laws passed by Congress and signed into law by the US President, are "Constitutional". The Court can wait until a case concerning a law is brought to the Court, or in some cases the Court acts on its own. To act without a case being brought to its attention & declared as unconstitutional was established in 1800.
