Car #3 is At Fault! The person turning left got a break from car #1 to make that left hand turn. Car #3 saw what was going on, came up an inside lane (against the law) and hit Car #1. Car #1 can collect damages from Car #3, and I hope Car #2 sticks around as a witness because Car #1 is going to need it unless there were other witness'. Car 1 is at fault for failing to properly yield to other cars while entering the road! If it were illegal for car 3 to pass car 2 for some reason, or car 3 was operating at an unsafe speed, they might share blame. But car 3 clearly has the right of way and car 1 failed to yield, and car 2 may be liable for creating the hazard by being stupid and waving car 1 into the path of oncoming traffic.
