It does NOT need to cite any particular statute; however, if your Attorney is worth their salt they will cite one. As for service, you can send or serve a cease and desist letter yourself. Although if you are using an Attorney I highly recommend you have your Attorney just pay a Process Server to serve the letter as you will have a record of service. If the person or company you are going to have served lives out of State, send the letter by Certified Mail with a RETURN RECEIPT for proof of signature. Process Servers can charge by the attempt to serve the person you are trying to serve.
