Under applicable rules of civil procedure, affirmative defenses not raised in the answer are generally deemed to have been waived. However, most courts are fairly lenient in allowing the amendment of an answer to allege overlooked (or newly discovered) affirmative defenses if the Plaintiff is not prejudiced by the amendment.
