Whoever has the tree planted in their garden is responsible for maintaining it and any costs associated with lopping branches etc. If neighbours complain about branches overhanging their yard and its your tree, fix it because if that branch results in any damage, say it falls during a storm etc, you are responsible for any damage!! I have just been through this with a neighbour, if the tree is in your garden, you're responsible, if its in theirs, it their responsibility.
