One scenario where the felony murder rule may seem unjust is when an individual is involved in a non-violent felony, such as burglary, and a co-offender unexpectedly causes a death during the commission of the crime. If the person who did not directly cause the death faces a murder charge and severe penalties, it can seem unfair that they are held equally responsible for an unintended outcome that escalated beyond their control. This can lead to disproportionate sentences for individuals who did not intend to harm anyone, undermining the principle of personal culpability.
