Yes you can re-open your BK to add a creditor. however, if it was a no asset case, there is no need to add them as their debt would be considered discharged.

My husband filed chapter 13 bankruptcy in November. His court date is January 25th. Will we get a tax return?

Sorry, but this makes no sense. A chapter 13 filed in November 2011 should have had a plan confirmed by now. If there is a court date of some kind for January, the case may be about to be dismissed. In any event, if the chapter 13 is still pending when you get your tax refund, it will have to be given to the chapter 13 trustee.

What happens when a person dies and they filed chapter 13 four years ago?

If the Chapter 13 Plan is still being paid and is still needed, it can continue. Someone will have to be responsible to continue the plan, whether there is an estate fiduciary (executor or administrator) or not. Check with the Chapter 13 Trustee.

If your landlord files Chapter 7 bankruptcy do you still pay rent during the months of the court process?

Yes you do. You're still receiving services -- in this case a place to live -- so you still are required to continue your agreement and pay rent.

If an account was not listed on the creditor's list of a chapter 7 is it still dischargable under the bankruptcy?

Yes it is. The presumption of bankruptcy is that all of the bills that were owed will be discharged at the time. If for a reason the bill that wasnt listed came up it can still be discharged by the court. Your attorney can file an addendum for this with the court after wards.

Can a person file for ch 7 bankruptcy even though he is still in ch 13 bankruptcy?

Yes and no. No you cannot file for two types of bankruptcy at the SAME time. But yes you can file for chapter 7 bankruptcy if you were unable to complete chapter 13, which is very common. This can be done once for any reason, without court approval. However, to switch back, approval of the bankruptcy court is required, and they will rarely allow a debtor to make multiple switches. Note that in switching from Chapter 13 to Chapter 7, much of the debtor's property is now up for grabs to be sold off to pay his or her debts. However, if the debtor cannot make the payments under a Chapter 13 bankruptcy, switching to Chapter 7 may be his or her only option.

Sold mobile home on purchase agreement still owe on mobile home buyers filed for chapter 7 what are my options?

The question is a little fuzzy, you have not stated if the Buyer(s) are still occupying the home. Also filing for Chapter 7 BK, may stop you from collecting your payment today, but the Buyer(s) will need to either reaffirm with you or move.Unfortunately, if the buyer does take the home and/or debt into Chapter 7 BK, you are out the money, to include back payments while they were living in the home. You will be sent a letter from the court giving you a chance to address the court on the debt. You may have information that may keep the Buyer(s) from filing Chapter 7, but you would need to attend court to find out.
