Since it is a puiblic gathering, was he assigned to attend to monitor the crowd and maintain order, as would be normal at any large public gathering (i.e.: high school football game - graduation - 4th of July - etc) ??. If he attended in an off-duty status it would be improper for him to be dressed for duty. If he spoke on an issue he might be in violation of some department regulation, but he also has a Consititutionally protected right of free speech.
