At least in the US, if they can't prove it you won't go to jail for the crime. You may be arrested and held for trial, but not for the crime itself.

I don't answer questions of specifically how long a person will stay in jail/prison for a certain offense. This depends on other circumstances, aggravating or mitigating, surrounding the offense.

Probation itself IS a sentence. If you abide by all the conditions of the probation sentence you will remain free of jail. If you violate the condition(s) of your probation your freedom can be revoked and you can be remanded to jail to serve the remainder of the term of your sentence.

The amount of jail time a person will get for battery will depend on the city and state. The DA may be able to work out a plea deal with no jail time. An attorney will be able to help you understand the law more in depth.
