If there is coverage, the insurer generally has the obligation to defend the insured by hiring a lawyer at its own expense, and paying any amounts for which the insured is found legally liable (up to the policy limits). Similarly, the insurer has an obligation to settle a claim within policy limits, and to thereby protect the insured from personal liability for any excess damages if it is possible to so settle the claim.
