Seeing as how Paul refers to "James the brother of our Lord" in Galatians 1:19 during his time in Jerusalem (the location of the events in Acts 12), it would seem likely that this is the James mentioned in Acts 15, who seems to take on an overseer position with the Church in Jerusalem. It would then make sense that in Acts 12:17 it is James the brother of Jesus that Peter is speaking to.
