Martial law can be enacted by any modern country (which has a military & government) at anytime. There is no need of a war for it to be used. Martial law can be declared, at the request of the city, county or state to the highest level of government, when civilian law enforcement can no longer control the crime wave that is happening in their jurisdiction.
Following World War II, Occupation authorities imposed a ban on martial arts for five years, because those that had been revived before the war were thought to foster the regimentation and nationalistic spirit that led to militarism. It was lifted in 1950 and Dai Nippon Budo Kai oversaw its implementation and introduction into the educational system as a sport.

This aspect of Martial Law puts the civilian population under the exclusive direction of the Congress. Does anyone question the reason Congress uses the word "war" when singling out a perceived social ill. There are so many other adjectives that can be used why use the word war. Does not a declared war place the population under Martial Law? Does the declaration of war not put the entire country in a combat zone? Think about it.
