after youre final appeals etc are done and the dust is settled you have a period of 12 months from your appeal deniel letter before you can RE-APPLY for your clearence

Yes. Several occupations in the military do not require a security clearance. More to the point you can't get a security clearance on your own. You have to be "sponsored" for one. For example you join up and have no clearance but you need one the military will "sponsor" you, essentially saying hey this guy is going to be handling sensitive material and needs to be checked out. Yes they can. I am in the same boat and have a clearance. It all depends on the security clearance interview that they will do to determine your character and what really happened with the felony.
