This can get a little dicey. While CPS investigations are not criminal prosecutions, they can turn into them. The investigation itself is not the issue. What you need to be aware of is whether during the investigation a court order was obtained to prevent you from removing the children from the jurisdiction. If there was and you did, you have a problem. Likewise, if you have charges filed against you, and you move to another state with the children, you could be facing additional charges of Fleeing and Eluding, Fleeing Prosecution, and potentially Kidnapping (which makes it a federal case and then you might be facing Avoiding Prosecution charges).
Your best bet is to contact a very competant Family Law Attorney in the state you left, and hire him to make certain the CPS investigation is cleared.
Keep in mind, that the case is not cleared until you have in your hot little hand paperwork that says the case is cleared. Take no one's word for anything related to potential criminal charges or the security of your children.
It might be important and prudent to note too that if the investigation was motivated by very real danger to your children, your best bet is to go back and face the music. If the first state or the FBI is forced to hunt you down, you will not be helping your case, and moving will not be a solution to the original problem. Fix what is broken, and running is not a way to fix it.
Can I move to another state if I show I'm established before my ex takes me to court
i think you have to take this to the courts.
Kody Brown and his family moved suddently from Lehi, Utah to Las Vegas, Nevada to escape the stress that a police investigation was putting on his family. Also the location of his home was quite well known and many paparazzi and fans of the show were stopping by his house and photographing his family, which made them feel uncomfortable.

if you are eligible for it in the state where you worked, that is the state responsible for paying any benefits, not the one you move to,
If you are trying to make some one move to another state, there are a number of possibilities........and all of them are illegal, or at the very least unethical!
Depending if there is an open investigation or if the investigation has finished without charges pending. The safest bet is to call the case worker or supervisor to determine the status of the case. If the case has criminal charges pending, that would be no. It is called fleeing to avoid prosecution. If you and your case worker have a Family Plan in place you must notify your case worker and quite possibly they will want you to set up an appointment with Family and Child Services in your new location. Anytime you are involved with a state agency you should notify your case worker or supervisor when you have a change of address. People who move during an investigation or with a Plan in place without notifying the agency, can face criminal prosecution.
