Two kids in high school, one 18 and the other 17, both roughhousing, no priors - probably not. 45 year old property owner surprised by a 17 year old burglar at 3am - probably not. 25 year old guy with priors and a 12 year old who sassed him - yes, that would be jail, at least, possibly prison.
