Maybe, but why would you want to? If the jerk doesn't have an interest in his child, I would keep him as far away as possible. Petition for sole custody instead and love and care for your child without him.

The mother of your child doesn't let his father visit with his child even though a mutual visiting rights agreement exists. How does the father obtain a visitation order through the court?

Inquire at the court that has jurisdiction over your case. If a visitation order is being violated file a motion for contempt and follow it through. If there is no visitation order then ask the court to set one up. A child has the right to visit with both her parents.Inquire at the court that has jurisdiction over your case. Can a mother deny visitation if the father is paying child support?

Whether or not a parent is paying child support is irrelevant when the issue is visitation rights. If there is a court order for visitation the primary custodial parent must allow it or be found in contempt of court. If there is not a court order in place the custodial parent can make the decision to when, where or if visitation is allowed. Visitation guidelines are usually established during the custodial proceedings.

Can you keep your son from visiting his father because you do not like his fathers new girlfriend even though there is nothing in the visitation schedule saying I have a right to do so?

I think I understand your question, but it's not asked very clearly. It's a little confusing. If I'm answering this wrong, then you need to re-ask and be more specific. As in "Can the mother of my child keep me from seeing the child just because she doesn't like my new girlfriend, even though there is nothing in the visition schedule saying she has a right to make that call?" No, you cannot keep your child from visiting with their father just because you don't like his girlfriend. She would have to take you to court and prove to the judge that the girlfriend is a danger to the child, then the judge would have to say the girlfriend can not be around the child. Then if she found out the girlfriend was still there when the child is visiting you, she could do something about it. Other than that, she have no legal right to keep the child from you. In fact, you could take her to court for violating the terms of the visitation.

Do you have to pay child support if you file for visitation rights?

Yes. Children are not for sale or barter. You have a right to visitation even if you don't pay child support - one has nothing to do with the other. Of course if you go to court and petition for visitation, you will get it, but they will also notice that you are deliquent and, as a separate matter, expect you to pay it. You can face jail time if you are too far behind.

Can an unwed mother deny visitation to the father in Missouri?

In Missouri an unwed mother has all the rights to the child until paternity is established. However, she also has all the responsibility. That means that she cannot ask for child support either, until paternity is established. She can deny visitation, but she can't get support. Once the father establishes paternity he can asks for the same rights and responsibilities as a married parent. If mom won't help dad establish paternity, he can go to the child support agency and ask them to help him establish paternity.

Will a judge grant visitation if the father came out of jail an never paid child support or never seen the child?

Unless you show cause that its in the best interest of the child not to see his father. For example if father has a violent record I doubt they will grant visitation. Also you can ask for monitored visitation.

What to do when custodial parent keeps child from visitation?

There is nothing you can do about it because child support and visitation are two separate things. Even though a person does not pay their child support, you can still get into trouble if you do not allow them to have their visits with the child.

Can a teenaged child choose not to visit noncustodial parent in Florida?

Children who are at an age of understanding, and able to make informed decisions for themselves (to a point) can choose to reduce or stop visitation. If possible, the custodial parent can petition the court to modify the custody and visitation with the request of the teenager, and the Judge may want to ask the teen some questions regarding their choice.

What you meant to ask how could you write a certified letter to ask a person to show up for court to ask for visitation?

Dear Ex: We have a child together. It is important that our child spend time with both of us, as we both love our child and want the best for our child. I am asking for visitation with our child in the amount of one weekend every two weeks, from Friday night until Sunday at 5 p.m. I believe this is reasonable and fair. If you do not choose to grant me visitation, I will request that the court give me an order of visitation, because I believe this is important. I know that you have our child's best interests at heart; I do, too, and I look forward to working together to raise our child. sincerely,

Should a parent pay support if the child will not come visit and doesn't want anything to do with them?

Support and visitation are two separate issues. Support is a responsibility just like anything else you "buy" If you sign a lease agreement on a car and then wreck it and can't drive it any more and didn't have insurance, you still owe for the car don't you? You can go to court and ask that your existing visitation order be enforced, in which case the judge will either determine that the child has a legitimate cause to cancel visitation or will order the other parent to present the child according to the schedule unless they want to be held in contempt. Either way you still have to pay your child support until you ask a judge to stop making you and they agree.

If the mother has full custody of the child and has dropped child support and the father has not been in the child's life for over half the child's life what right does he have to see her?

Child support and visitation rights are different issues. If there is no visitation order from the court the custodial parent can decide if visitation will be allowed and if it is, the terms, such as days, hours, etc. The non-custodial parent can file a petition with the court for visitation rights if an amicable solution cannot be agreed upon. Generally there must be a documented history of abuse or serious neglect before a judge will refuse a biological parent visitation rights. There are 2 different things. Legal custody and Physical custody. Regardless, child support and visitation are two completely different matters. He CAN ask the courts for visitation, it does not matter if he has been paying or not. If the father has no documented record of abuse with the child or any other violations then there's no right against him seeing the mother in which case he asks the court.

Can the non custodial parent lose visitation rights if he has a bench warrant issued?

It depends on what the warrant is for. If the crime committed will expose the child to any harm, you need to contact the court and make them aware of it and ask them to modify/change his visitation rights.

If parent is no paying support do the children have to go with him?

First thing..in Indiana...most courts view support and visitation as two separate issues. If the support is required through the courts the judge will ask what the visitation is at that time. However, if the non-custodial parent wants to get visitation without the custodial parents agreement, the non-custodial parent will have to file a request with the court and have a judge issue visitation. If there is no visitation order in place by a judge/court, the custodial parent has no legal requirement to permit visitation. I have dealt with this issue personally as well as my sibling, me being a custodial parent my sibling being a non-custodial parent. So I have seen what happens from both sides. Basically if it something isn't ordered by a judge/court, there is no legal requirement to do visitation or support.

Can a 12 year old child tell the court what parent they want to live with?

What if the mother tells you after a judgment that it's not your child and rejects child support and gift for the child with a refusal of visitation do you still owe child support?

You need to go back to court, ask for DNA testing.
