The real Nathan is dead, There is no way he could have survived given the wound he sustained from Sylar. ( Neck slitting )
However Matt Parkman, was begged by Angela to persuade Sylar that HE was Nathan, so now Gabriel Gray believes he is in fact Nathan Petrelli- but with a force as strong as Sylar's I doubt It will last.

In the end of the last volume - 'Fugitives' Peter and Nathan comfront Sylar - Peter needed to touch him in order to gain the abilities he had. He does. Things for Nathan however don't go so well, Sylar slits his throat, killing him in a matter of seconds. Elsewhere Peter uses one of the abilities he gained to shapeshift into the president - he then waits for Sylar. Sylar takes the bait and meets up with 'the president' in the back of a car, he shakes his hand ( hoping that from this he can become him) but Peter shapeshifts into himself ( yum) and sticks a needle into sylars neck. 'Bet you didn't think I took that one from you' Angela...desperate to gain her son back, begs Matt to tell Gabriel that he is no longer himself and that he is Nathan. Believing this, Sylar adopts Nathan's form and personality. However in the Season four trailer 'Nathan' is seen fixing a clock....is Sylar resurfacing??

If you meant when did Peter Petrelli get his powers back it was in Season 3 episode 13 "dual" by injecting himself with the formula however his power was different to his original power as he could only hold on to one power at a time and he had to touch the person to absorb the power :).
