She did not give them up, she gave them to their father! And the queens can be deputy, just not when their nursing or expecting kits!
Edit: There's nothing in the warrior code that says queens cannot be deputy (or leader), so a queen could be in one of these positions, in theory. In practice, a queen likely could not perform deputy duties, and would likely not be accepted by the Clan. This is why Bluestar gave her kits to Oakheart; she was afraid that she would not be chosen as deputy if she had kits to take up her attention, and Thistleclaw would instead become deputy.
