Charlie Kaufman really was the screenwriter for Being John Malcovich (and Adaptation). The BJM actors shown in the film are the real actors. Susan is also a real person and she did write a book called "The Orchid Theif". I believe that La Roche exists in real life too but I'm not sure. Donald Kaufman doesn't. The guy who runs the screenplay seminar does.
I believe Charlie really did go through a similar struggle trying to "adapt" the orchid thief into a movie and the way he came up with a lot of "Adaptation" was similar to what we see in the film. I don't know to what extent that's true though. Some of the Hollywood characters in the film (his agent etc.) could be real people too.
However, I think we can safely assume that the last 3rd of the movie is almost completely fictional.
