If the parents are not suspected of the crime in question than no. If they are a lawyer or guardian should be present with the girl. Also they can "ask" all they want but ordering her to...no. In order to answer this question, we need to know in what state because sometimes the legal definition of a minor is different than what you think. For example in NY the legal age to be tried in adult court is 16 and therefore someone under 18, if they are over 16 can be questioned like an adult, at least for some crimes * Yes. There are no laws in the US that require a juvenile have a parent present while the juvenile is questioned by authorities. The juvenile can, as can any citizen regardless of age refuse to answer any questions and request legal counsel. Additionally there is no law that says the minor or any citizen of any age must comply to a request by the police to present themselves for interrogation, it is strictly voluntary. It requires a court order from the judge seated in the court of jurisdiction for any person who has not already been placed under arrest to be taken into custody to be questioned You've certainly received some excellent info above, directly to your question. May I suggest a more pragmatic response: As a parent you certainly want to protect your daughter from everything possible. And while I may not be blindly observant of any policemans dictates, I should think you also want to instill the importance of cooperating with them to aid others. The real question is whether they want to entangle her in problems, or have her assist in resolving one. Perhaps they believe she can shed light on a situation they are investigating concerning a friend or acquantince...like abuse, a runaway, someone thought to maybe be planning something bad at school, etc. Under todays laws and procedures, the cops may simply not be able to divulge much to you. The answer I believe is best is to hire an attorney for her fast - if finances are a real concern I'd wager under the circumstances you can find one to represent her very reasonably. And the point is to represent her. Clearly, he should be able to determine the scope of the police interest. If it is something she may know that can help some one elses child, or society, without jeopardizing herself, he can see that her participation happens properly. If it seems they believe that she is involved in something particularly unsavory, he can take the appropriate actions to protect her, (which may need to include involving you to see she has the guidance to change course and direction). Basically, a call like that really says there is something going on you really need to see her through, and not just try and avoid!

Can you stop the police interviwing your daughter?

This depends on how old your daughter is, which state you are in and the reason your daughter is being interviewed. Some states don't permit a juvenile to be questioned unless a parent or guardian is present. There are exceptions to this, as in when the parent or guardian is a suspect in a crime against the juvenile; even then, there may be a requirement to have an adult advocate present to protect the juvenile's interests. Other states have no such requirements. If your daughter is no longer a juvenile, you probably have no say as to whether she is questioned at all.

Can school officials question a student without parents present?

Teachers and administrators can question kids. If a police officer is present or performing the questioning, a child has a right to both an attorney and their parent. Check your school district''s webpage and your state's code. For example, google "Michigan State Code, interrogation of a minor" and see what the age and rules are for your state.

What questions can the police ask a juvenile?

The only difference between the questioning of a minor as opposed to an adut, is that a parent or guardian must be present and give consent prior to the questioning. Other than that, the same rules apply (i.e. Miranda rights, etc.)

Does a parent need to be present when a minor victim is questioned or can it be another family member?

I do not believe that the VICTIM must have a parent/guardian present, although it is probably advisable - the laws only address the custodial questioning of a juvenile who is in custody. It would make no sense for a requirement that a parent/guardian be present for the questioning of a victim - if none could be immediately found the crime or injury inflicted upon the victim could not be followed-up on, or investigated, until, perhaps, the chance of apprehension of the offender, had passed.
