It varies by state. Basically all states require the grandparents to show that visitation is in the best interest of the children, all that means is the visits wont hurt/harm or be detrimental to the children. Some states just require that to be met in order to file a case for visitation. Other states grandparents cannot file if the parents have allowed ANY visitation, no matter how limited. Two of the strictest states (MN,PA) require the children have lived WITH you at some point. Still others require that you can prove that you had a Parental role in their lives instead of a grandparents role.
