The issue is not so much what consequences the seventeen years old might encounter, but what action could be taken against the adults who allow the minor to reside with them. Any adult who allows an underaged person to live in their home w/o the custodial parent(s) permission can be held accountable under both civil and criminal statutes.

If a mother with a child enters rehab to fix her problems can the father get full custody where they already have joint custody?

It really depends. I think that the mother and father should have full custody. I say this because the mother is doing this to get better, for the benefit of her kids. Some might argue that she should not have custody because why would she had to go to rehab in the first place. It really depends. I think that the mother and father should have full custody. If the child is in foster care you pay but not if the child is adopted. Then the child have new parents who are responsible for him/her.

Can family members get custody of a child because they do not want the child's parent to move to another state?

If the parents want to move, the girl must go with them unless she is 18. If she is old enough and responsible, some parents let their kids live with a trusted family until they finish high school - but that is totally up to the parents because they are legally responsible for their kids. Another family cannot get custody of a girl just because they don't want her to move. A judge won't take a biological daughter away from the family for a stupid reason like that. If the girl is abused, neglected or just just lives with her friends, they have a better chance of attaining custody.

What can a father do who is willing to fight for custody for his children and the mother is not following the custody court order?

Talking to his lawyer would be the best idea. You can then return to the judge and appeal that the order is not being followed, so perhaps custody should be changed (provided you can prove that you are responsible enough).

Can your boyfriend get custody over you and your son if he is 19 years old?

Yes, when you marry him. No, he doesnt get custody over you and your son just because he is 19. If your married to him you and the boy are dependents, meaning he is financially responsible. Just being boyfriend and girlfriend has no legal boundaries. He doesnt just get the baby either. The mother usually has the inherent rights over baby unless father takes her to court to fight for custody.
