Usually, that's up to the driver / parents' discretion. The safest place for a child is always the back seat. However, if he or she is big enough for the seat belt to hold him or her in the proper position, it'll be OK.

It is safe and legal for a child of any age to sit in the front passenger side of the car. They must have the correct child restraint for their height and weight.
I believe it is 14 but i think there is also a weight requirement
In the state of Illinois, a child must remain in the back seat until age 12. Even then it is not recommended that they ride in the front seat because they could be seriously injured or killed if the air bag opened.
If a child is to sit in the front of a car with an airbag, they MUST BE 80 POUNDS!!
